Hostess values the privacy of those who use our mobile application (“Application”), content and
services and makes all commercially reasonable efforts to protect it. This Privacy Policy covers
the collection, use and disclosure of personal information that may be collected any time you
interact with Hostess, such as when you visit our web Application, use services, or communicate
with Hostess employees. Please read the following to learn more about what information we
collect, what we do with that information, and how we may use your personal information.

Information Collection: The Personally Identifiable Information We Collect

The primary reason that we collect certain personal information is to provide the best possible
level of customer service. It enables us to deliver service announcements, software updates and
special offers as well as provide convenient and personalized user access and improve the
features and usability of our products.

In the course of using this Application, you may provide us with personally identifiable
information. This refers to information about you that can be used to contact or identify you, and
information on your use of and activities at our Application that may be connected with you
(“Personal Information”). Personal Information that we collect may include, but is not limited
to, your name, phone number, credit card or other billing information, email address and home
and business postal addresses. Personal Information may also include information you supply to
us concerning your preferences and interests expressed in the course of use of our Application.
We also collect information about your visit from the browser or Hostess application on your
computer or mobile device, including IP address, cookies and the pages you request – to
analyze trends, administer the Application, track your navigation of the Application, deliver
relevant advertisements and gather broad demographic information for aggregate use (note that
IP addresses are not linked to “personally identifiable information”). Additionally, we collect
aggregate information from multiple users without personally identifying individuals, such as
geographic region, which we may share with our business partners – to improve understanding
of customer needs and provide relevant services.

How We Use Personal Information

Personal Information is or may be used for the following purposes: (i) to provide and improve
our Application, services, features and content, (ii) to administer your use of our Application,
(iii) to enable you to enjoy and easily navigate the Application, (iv) to better understand your
needs and interests, (v) to fulfill requests you may make, (vi) to personalize your experience,
(vii) to provide or offer software updates and product announcements, and (viii) to provide you
with further information and offers from us or third parties that we believe you may find useful
or interesting, including newsletters, marketing or promotional materials and other information
on services and products offered by us or third parties.

We use information we obtain by technical means (such as the automatic recording performed by
our servers or through the use of cookies) for the above purposes and in order to monitor and
analyze use of the Application and our services, for the Application’s technical administration, to
increase our Application’s functionality and user-friendliness, to better tailor it to your needs, to
generate and derive useful data and information concerning the interests, characteristics and web
use behavior of our users, and to verify that visitors to the Hostess Application meet the criteria
required to process their requests.

Location data

Hostess can provide helpful information based on where you are. If you tell us where you are
(i.e., by allowing your mobile device to send us your location), we may use that information to
provide you with location-based information. If you want to deactivate this feature, you can
disable location services on your mobile device, please contact your carrier for more
information.

Social Media

You can choose to access certain third party social media web sites and services through the
Hostess Application as well as share information using social media. When you do so, you are
sharing information with those sites, and the information you share will be governed by their
privacy policies. You can modify your privacy settings with those third parties directly. Hostess
does not control the privacy policies of such third parties and assumes no responsibility or
liability for the actions of such third parties.

Information disclosure to third parties

When you send information to the Hostess service, you are granting Hostess permission to use
and take other actions with respect to such information (as described in the Terms of Service), in
order to provide Hostess’s services. We do’not share, sell, rent or otherwise distribute this
information to others, except as disclosed in this Privacy Policy. Hostess may share your
information with others outside of Hostess under the following circumstances:

We have your explicit consent to share the information;

We need to share your information to fulfill your service request;

We wish to contact you with information about products and services from our business partners, which we may do
unless you “opt-out” of such communications by contacting us via the contact
form, or by clicking the unsubscribe link found within Hostess email updates;

We have a good faith belief that sharing or otherwise permitting access, disclosure, use or
preservation of such information is reasonably necessary in order to comply with our legal
obligations;

You have explicitly requested information from Hostess business partners, in which case it will
be clear at the point of collection who is collecting the personal information and whose privacy
statement will apply;

We believe it is necessary in order to investigate, prevent or take action regarding illegal
activities, suspected fraud or potential threats against persons or property;

We believe it is necessary to investigate potential violations of our Terms of Service, or to
enforce those Terms of Service; or

We have a relationship with an affiliate or partner that you have an online or off-line (non-
Internet) relationship with, or have visited the affiliate or partner’s web Application that links to
or mentions Hostess’s web Application, and have registered for Hostess’s online services
through the partner or affiliate’s program or web Application.

Cookies

Cookies are small data files that a web Application you visit may save on your hard drive that
usually includes an anonymous unique identifier. A cookie cannot retrieve any other data from
your hard drive, pass on computer viruses, or capture your e-mail address. The Hostess web
Application uses cookies for user authentication, keeping track of your preferences, promotional
campaigns that require user identification, keeping track of our audience size and traffic patterns,
and in certain other cases.

You can configure your browser to accept cookies, reject cookies or notify you when a cookie is
being used. However, if you configure your browser to reject cookies, you may not be able to
use Hostess products or services that require you to sign in or take advantage of all the features
of Hostess.

Hostess may allow third party business partners that display advertisements on some of our web
pages to maintain their own cookies on your computer. These business partners do not have
access to Hostess’s cookies and their use is subject to their own privacy policies.

Links

The Hostess web Application and services may contain links to other Applications and
advertisements. Hostess is not responsible for the privacy policy or other practices employed by
websites linked to, or from, our web Application nor the information or content contained
therein. This privacy statement applies solely to information collected by this web Application.

Data Security

Hostess takes the security of your data seriously. In order to protect your information, we have
implemented various security measures. For example, anytime you transmit to and from Hostess
over the internet, that information is encrypted using secure socket layer technology (SSL).
Hostess also follows generally accepted industry standards to protect the personal information
submitted to us, both during transmission and once we receive it.

Hostess is committed to protecting the security of your information and takes reasonable
precautions to protect it. However, Internet data transmissions, whether wired or wireless,
cannot be guaranteed to be 100% secure and as a result we cannot ensure the security of
information you transmit to us; accordingly, you acknowledge that you do so at your own risk.
Once we receive your data transmission, we make all commercially reasonable efforts to ensure
its security on our systems.

Your personal information and data stored in our systems is protected by various physical,
electronic and procedural safeguards. It is housed in a secure facility and Hostess restricts
physical and network access to this facility to select trained staff and regularly evaluates its
technologies, facilities, procedures and potential risks to maintain the security and privacy of our
users’ data. As a rule, Hostess employees do not monitor or view your personal information or
content stored in the Hostess service, but it may be viewed if we learn that our Terms of Service
may have been violated and confirmation is required, or we otherwise determine that we have an
obligation to review it; and certain Hostess services support the use of standard SSL encryption
to protect data transmissions. However, this is not a guarantee that such data transmissions
cannot be accessed, altered or deleted due to firewall or other security software failures. When
you sign a document using the Hostess app, the signature is stored locally on your device. When
you send the document to our service via email, the document is stored on Hostess servers and
pulled from the Hostess cloud when the signature is being attached to the document. The
original document and the signed document are deleted from Hostess servers once they are sent
back to you via email. Your signature is never stored permanently in our cloud. The files stored
on your Hostess are accessible only to you via your Username and password. When you email
the document to Hostess from iPhone or your computer, it is emailed directly from your iPhone
or computer’s built in email client. When the document is inside your email client, it is no
longer under our protection and could become at risk of being viewed by others.

When you delete a document from the Hostess cloud, it is removed from our system. A backup
copy of that document might exist in one of our backup archives until it is purged by a newer
backup. Our current backup rotation purges documents after 31 days.

If Hostess learns of a security system breach we may attempt to notify you and provide
information on protective steps, if available, by posting a notice on our web Application.
Depending on where you live, you may have a legal right to receive such notices in writing. To
request written notice of any security breach in writing, please send an e-mail with your request
and mailing address to info@myhostessapp.com or via postal mail to the address in the Contact
Us section below

International Users

Hostess abides by the safe harbor framework set forth by the U.S. Department of Commerce
regarding the collection, use, and retention of personal information collected from the European

Our Policy Toward Children

This Application is not directed to children under 13 years of age. We do not knowingly collect
personally identifiable information from children under 13. If a parent or guardian becomes
aware that his or her child has provided us with Personal Information without their consent, he or
she should contact us at info@myhostessapp.com. If we become aware that a child under 13 has
provided us with Personal Information, we will delete such information from our files.

Changes and Updates

As this Privacy Policy may be updated from time to time, we will revise and display the effective
date at the top of the web page. You should periodically review it to keep abreast of our plans
and procedures to protect the personal information that we collect. Your continued use of the
Hostess services constitutes your agreement to this Privacy Policy and any updates.
If Hostess should ever sell its assets, merge with another entity or file for bankruptcy,
information collected from this web Application and in the operation of the services may be
transferred as assets of Hostess.
